Losing a loved one is an emotionally taxing process, which is compounded by the mental burden of sorting through their estate. Capita Law assists families in New Jersey and Pennsylvania with the complex — and numerous responsibilities — of administering one’s estate.

Andrea is committed to helping clients navigate the process of estate planning from beginning to end. Our firm not only helps clients create or update their estate plans, wills, and trusts, but we also assist executors and administrators on how to manage and distribute an estate.

Many people mistake estates and trusts as similar things, when in reality they are fundamentally different and have individual purpose.

Estates are a one-time transfer of assets as outlined in your will, distributed by the appointed executor after your passing to those indicated as inheritors or beneficiaries. This is why many professionals consider a will the core of your estate plan - it outlines the executor, beneficiaries, and clearly outlines your wishes.

On the other hand, trusts are an ongoing transfer of assets to beneficiaries before and after death, usually handled by the trustee.

SO WHAT'S THE DIFFERENCE?

The biggest difference between estate administration and trust administration is that trusts do NOT need to go through probate, unlike a will. Probate can be a difficult and challenging process if there are disputes, delaying the administration of your estate's assets.
